Please read these Terms of Service carefully before using the Eleva Wellbeing platform. By accessing or using Eleva Wellbeing, you agree to be bound by these Terms. If you do not agree, please do not use the platform.
1. About Eleva Wellbeing
Eleva Wellbeing is a digital mental wellbeing platform operated by Eleva Wellbeing Ltd, a company registered in England and Wales. The platform provides personalised daily micro-interventions, emotional check-ins, progress tracking, and signposting to professional care resources.
Important: What Eleva Wellbeing is not
Eleva Wellbeing is not a medical device. Eleva Wellbeing is not a crisis service. Eleva Wellbeing is not a substitute for professional mental health care, therapy, or medical advice. The content, tools, and features provided by Eleva Wellbeing — including PHQ-9 and GAD-7 screening tools — are provided for informational and wellbeing support purposes only and do not constitute clinical diagnosis, clinical treatment, or medical advice.
If you are experiencing a mental health emergency, please contact the appropriate emergency services (999 in the UK) or a crisis helpline (Samaritans: 116 123, available 24/7).
2. Eligibility
You must be at least 18 years of age to use the Eleva Wellbeing platform. By using Eleva Wellbeing, you confirm that you are 18 or older. The platform is intended for adults based primarily in the United Kingdom. If you are located outside the UK, additional terms may apply.
3. Your Account
To access certain features of Eleva Wellbeing, you may be required to create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately at support@elevawellbeing.app if you suspect unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
Eleva Wellbeing reserves the right to suspend or terminate accounts that violate these Terms.
4. Use of the Platform
4.1 Permitted Use
You may use Eleva Wellbeing solely for your personal, non-commercial wellbeing purposes in accordance with these Terms.
4.2 Prohibited Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of applicable law
- Attempt to gain unauthorised access to any part of the platform or its infrastructure
- Upload, transmit, or share content that is harmful, offensive, abusive, or misleading
- Use the platform in any way that could damage, disable, or impair its functionality
- Reverse engineer, copy, or attempt to extract source code from any part of the platform
- Use the platform on behalf of any third party without their consent
5. Clinical Screening Tools — Important Notice
Eleva Wellbeing incorporates validated clinical screening instruments — specifically the Patient Health Questionnaire-9 (PHQ-9) and the Generalised Anxiety Disorder Assessment-7 (GAD-7) — as part of its wellbeing check-in feature.
You acknowledge and agree that:
- These tools are used for informational and wellbeing tracking purposes only
- Eleva Wellbeing's use of PHQ-9 and GAD-7 does not constitute a clinical diagnosis or clinical assessment
- Results generated by these tools within Eleva Wellbeing are not shared with healthcare professionals unless you choose to do so
- If your scores indicate that you may benefit from additional support, Eleva Wellbeing will signpost you to appropriate professional resources — this signposting does not constitute a referral or clinical recommendation
- You should always seek professional advice from a qualified healthcare provider if you have concerns about your mental health
6. Escalation Pathway
Eleva Wellbeing includes a structured signposting feature that may be activated when certain thresholds are detected in your check-in data. This feature is designed to guide you towards appropriate professional resources including GP services, therapist directories, or crisis helplines.
This feature:
- Is not a substitute for emergency services — if you are in immediate danger, call 999
- Does not involve real-time human monitoring of your data by Eleva Wellbeing staff
- Does not constitute a clinical referral or emergency intervention
- Is intended as a compassionate prompt to seek professional support when your data suggests it may be beneficial

7. Intellectual Property
All content, features, and functionality within the Eleva Wellbeing platform — including but not limited to text, graphics, exercises, audio content, clinical frameworks, and AI recommendation logic — are owned by or licensed to Eleva Wellbeing Ltd and protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Eleva Wellbeing content without our express written permission.
8. Data and Privacy
Your use of Eleva Wellbeing is also governed by our Privacy Notice, which explains how we collect, use, and protect your personal data — including sensitive health data generated through the platform. Please read our Privacy Notice carefully. By using Eleva Wellbeing, you consent to the data practices described in that document.
9. Disclaimers and Limitation of Liability
9.1 No Warranty
Eleva Wellbeing is provided on an 'as is' and 'as available' basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or fitness of the platform for any particular purpose.
9.2 Limitation of Liability
To the maximum extent permitted by applicable law, Eleva Wellbeing Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or damage to health, arising out of or in connection with your use of the platform.
Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.
9.3 Mental Health Disclaimer
Eleva Wellbeing is a wellbeing tool. It is not designed to replace professional mental health services. We strongly encourage users to seek qualified professional support for any significant mental health concerns. Eleva Wellbeing accepts no liability for any outcomes resulting from reliance on the platform as a substitute for professional care.
10. Changes to the Platform and Terms
We may update these Terms from time to time. Where changes are material, we will notify you within the platform or by email. Continued use of Eleva Wellbeing after notification constitutes acceptance of the revised Terms.
We reserve the right to modify, suspend, or discontinue any feature of the platform at any time without notice.
11. Termination
You may stop using Eleva Wellbeing at any time. We reserve the right to suspend or terminate your access to the platform if you breach these Terms or if we reasonably believe your use of the platform poses a risk to you or others.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
